We, Crust Nation, iBoatNYC, any and all company affiliates assume no responsibility or liability for: (a) Any lost or stolen items/personal belongings (b) Delayed boarding, departure or return due to circumstances beyond our control that affect event times (c) Physical altercations or misbehavior of any and all attendees and participants (d) Fires, damage and/or other safety hazards beyond our control (e) Changes in event times and/or circumstances due to inclement weather conditions 3. In order to enter our events all guests must bring corresponding valid ID (Passport is required for International Guests). No photocopies or pictures of IDs will be accepted. 4. Note: (a) The boat/venue is subject to change (b) The pier/location is subject to change If the boat and/or pier is changed, customers will be notified via email to the best of our ability. 5. All patrons are subject to mandatory security check. We reserve the right to refuse entry to guests who are: (a) Under the influence of drugs and/or alcohol (b) Attempting to bring prohibited items on board including but not limited to: - weapons - food - illegal substances - anything security deems a safety issue/hazard (c) Using any and all fake/false identification(s) 6. In the event of an emergency, including fires and other life threatening hazards, the event may end before it's scheduled time. 7. We reserve the right to refuse refund requests on the basis of the following, including but not limited to: (a) Illness, injury, and/or lateness (b) Inclement weather conditions (c) Emergencies beyond our control (d) Denied entry under the conditions stated above 8. In the event a refund is granted, we assume no liability or responsibility to reimburse any and all costs associated with travel. This includes but is not limited to: (a) Car service, including but not limited to: Uber, Lyft and any and all other ride sharing apps/services (b) Gas (c) Tolls (d) Any and all other associated fees (e) Parking Garages (f) Street Parking (NY DOT Meter Charges) (g) Parking Tickets (h) Towing Charges (i) Trains, buses, any and all other forms of public transportation Furthermore, we have no control over ticketing fees and assume no responsibility or liability to reimburse them in the event a refund is granted. 9. VIP Services. VIP packages do not include alcohol. To secure table access for the entire night, a minimum of one bottle must be purchased on the yacht. Failure to meet this requirement may result in forfeiture of table access. 10. We assume no liability or responsibility to reimburse any and all fees associated with chargebacks UNLESS we have failed to respond to your request in some form within 30 days of the complaint. 11. Guest Waiver of Liability. By purchasing this ticket and/or attending the Event you understand and agree that, iBoatNYC nor its affiliate and subsidiary corporations, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”) may be held liable or responsible in any way for any injury, death or other damages or liabilities to you, your family, estate, heirs or assigns that may occur as a result of my participation or attendance to the Event or as a result of any act or omission of the Released Parties, including but not limited to, the negligence of any type by any party, including the Released Parties, whether passive or active. 12. Notice of Filming and Photography: (a) When you enter a Crust Nation (“CN”) event or program, you enter an area where photography, audio, and video recording may occur. (b) By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by CN and its affiliates and representatives. Images, photos and/or videos may be used to promote similar CN events in the future, highlight the event and exhibit the capabilities of CN. You release CN, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. (c) By entering the event premises, you waive all rights you may have to any claims for payment of royalties in connection with any use, exhibition, streaming, webcasting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, webcasting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recordings taken by IBOATNYC/Crust Nation or the person or entity designated to do so by IBOATNYC/Crust Nation.
